GENERAL TERMS AND CONDITIONS OF SALE

These terms and conditions are intended to govern the relationship between, on the one hand, MAISON 91, Registered office: Carretera Andratx, 9 - 07181 Portals Nous - Balearic Islands - Spain, under number ESY8824115-H
Hereinafter referred to as MAISON 91, the seller, and on the other hand, individuals wishing to make one or more purchases via the e-commerce website, hereinafter referred to as THE SITE CUSTOMER. These General Terms and Conditions of Sale apply without restriction or reservation to all sales concluded by MAISON 91 with non-professional SITE CUSTOMERS wishing to acquire the products offered for sale on the said site.

PRICE

Prices are indicated in euros, all taxes included. Unless there is a text error or omission, the prices indicated are guaranteed within the limit of available stocks.
MAISON 91 reserves the right to modify its prices at any time, but products will be invoiced on the basis of the rates in effect at the time of order validation, subject to the availability of said products.
When a validated order contains one or more erroneous elements (price, description, photo, etc.), MAISON 91 reserves the right to cancel it and proceed with a refund.

ORDER

THE SITE CUSTOMER may place an order on the Website www.maison91.fr. The contractual information and order details are presented in French and are subject to a detailed summary before final validation. MAISON 91 reserves the right to cancel or refuse any order from a customer with whom there is a dispute regarding payment of a previous order, total or partial non-payment of that order by THE SITE CUSTOMER, refusal of credit card payment authorization by banking institutions, or non-payment or partial payment. MAISON 91's liability may under no circumstances be engaged in this respect. As soon as THE SITE CUSTOMER validates their payment, the order is recorded and becomes irrevocable. The order form will be stored on MAISON 91's computer records, which are themselves kept on reliable and durable media, and will be considered as proof of the contractual relations between the Parties. Once payment has been validated, a confirmation of the order will be sent by email to the email address indicated by said SITE CUSTOMER at the time of the order.

PAYMENT

All information exchanged to process the payment is encrypted using the Paypal protocol. This data cannot be detected, intercepted, or used by third parties. Nor is it stored on our computer systems.
When you are asked to enter your credit card number, you can check from your browser that you are in a secure area. We accept payment by credit card: Carte Bleue, Visa, Mastercard, and American Express. Payment by postal check, bank check, bank transfer, or administrative order is not accepted.

DELIVERY

Any order placed on the MAISON 91 site will be prepared and shipped within 2 days, subject to payment validation and the workshop being open.
Shipping costs are free for all orders placed and sent in France from €100 of purchase. Delivery of your order is provided via MONDIAL RELAY and will be delivered to your MONDIAL RELAY point within 5/6 business days, or via CORREOS within 7/8 business days.

RETURN AND REFUND

In accordance with the provisions of Articles L221-18 et seq. of the French Consumer Code, the SITE CUSTOMER has the right to withdraw from their order. They have a period of 14 days to withdraw from their purchase without having to justify any reason.
The 14-day period runs from the day the SITE CUSTOMER received the ordered item.

This right is exercised by returning the product, with the postmark serving as proof. Shipping costs remain the responsibility of the SITE CUSTOMER. It will be up to the SITE CUSTOMER to keep any proof of this return, which assumes that the items are returned by registered mail or any other means giving a certain date to this shipment. The return of goods is at the expense, risk, and peril of the SITE CUSTOMER (it is therefore recommended to declare the value of the merchandise and to take out insurance covering these risks). It is recommended to return the product(s) via tracked Colissimo requiring a signature. The return address is as follows: Marie BAK - Carretera Andratx, 9 - 07181 Portals Nous, Balearic Islands - SPAIN. (postmark serving as proof).
The Company will refund the payment received corresponding to the product that is the subject of the withdrawal within 14 business days from the moment it was informed of the Customer's decision to exercise their right of withdrawal.

The refund period will be deferred until the product returned by the Customer has been received and verified.
However, we draw your attention to the fact that the refund of jewelry can only occur if all the following conditions are met:
1) The returned product must be sent back perfectly intact; it must not have been worn, used, modified, deteriorated, or undergone any handling likely to prevent its resale in new condition.
2) The product must not have been made to measure, nor be a personalized piece of jewelry.
3) The product must be returned in its original packaging accompanied by the purchase invoice

4) These conditions are not valid for orders of Outlet items, nor for those benefiting from a specific promotional coupon code.
Upon receipt of the package, MAISON 91 will judge the perfect condition of the returned merchandise. No return will be accepted if the returned products have been visibly used or damaged due to the customer and this use or damage renders the products unfit for sale. If the return is refused by MAISON 91, the products will then be returned to the customer at MAISON 91's expense, without the customer being able to demand any compensation or right to a refund, with the exception of the subsequent exercise of their warranty rights on the goods sold. Product refunds will be made within a period of less than or equal to 15 days after receipt of the products. The refund will be made by credit to the SITE CUSTOMER's bank account.

INTELLECTUAL PROPERTY

A SITE CUSTOMER who has a personal website and wishes to place, for personal use, a simple link on their site pointing directly to the site's homepage must obtain authorization from MAISON 91. In any case, any link, even if tacitly authorized, must be removed at the request of MAISON 91. Hypertext links may point to other sites. MAISON 91 disclaims all liability if the content of these sites contravenes the laws and regulations in force. Any copying or use of any of the brands sold on our site, or any parasitism based on our sales method, is strictly prohibited and will be immediately prosecuted and sanctioned.

LIABILITY

MAISON 91 only has an obligation of means for all stages of access to the site, the ordering process, delivery, or subsequent services. MAISON 91 cannot be held liable for any inconvenience or damage inherent in the use of the Internet, in particular a service interruption, external intrusion, or the presence of computer viruses, or any event qualified as force majeure, in accordance with case law. The products offered comply with current Community legislation and standards applicable in France. MAISON 91 cannot be held liable for non-compliance with the legislation of the country where the product is delivered (for example in the case of a product ban). MAISON 91 shall not be held liable for non-performance of the contract in the event of force majeure, disruption or total or partial strike, particularly of postal services and means of transport and/or communications, flood, or fire.

PERSONAL DATA

In accordance with Law No. 78-17 of January 6, 1978, relating to data processing, files, and freedoms, the processing of personal information collected on the site has been declared to the French National Commission for Data Processing and Liberties (CNIL declaration). THE SITE CUSTOMER has the right to access, modify, rectify, and delete data concerning them. To exercise this right, THE SITE CUSTOMER must send an email to MAISON 91's customer service. In any case, THE SITE CUSTOMER must remember to include their surname, first name, and address.
Finally, MAISON 91 may be required to communicate personal information to its commercial partners. THE SITE CUSTOMER may thus receive commercial offers from third parties. However, with regard to their email address, it may be communicated to said partners unless THE SITE CUSTOMER objects. Naturally, subsequently, THE SITE CUSTOMER retains the possibility of refusing such communication by expressing their refusal by post or by email, in accordance with the paragraph above. Certain web pages of the site may sometimes contain electronic images or "web beacons," which allow the number of visitors to the page to be counted. These web beacons may be used with some of our partners, in particular to measure and improve the effectiveness of certain advertisements. In any case, the information obtained via these beacons is strictly anonymous and simply allows for the collection of statistics on the traffic to certain pages of the site, in order to better serve the customers of our site.
